You should apply for a California REAL ID only if you also have one of DMV’s listed REAL ID identity documents; otherwise, use a qualifying I-797 approval to apply for a regular federal non-compliant driver’s license.

I have a valid I-797 but an expired U.S. visa in my passport. Am I still eligible for a California REAL ID driver’s license, or should I apply for a regular driver’s license instead?

Summary

An expired visa stamp does not automatically mean your lawful stay expired; your I-94 and approved status control that question. The manageable part is matching your exact I-797 and other documents to the correct DMV route.

The correct license depends on what your I-797 approves and whether you have another document on California DMV’s REAL ID list.

Apply for REAL ID with a listed document setREAL ID route

Choose REAL ID if you can present a listed combination: a valid or expired Permanent Resident Card with I-797/I-797C; a valid EAD; or an unexpired passport with a valid visa and . DMV also lists several less common documents, including a passport stamped “Processed for I-551” and TPS eligibility documents. Your lawful presence must pass verification.

Apply for a regular federal non-compliant licensedriving route

Choose this route if your states that USCIS approved an extension of stay or change of status granting temporary or permanent residency, but you lack a listed REAL ID document combination. DMV expressly accepts that notice for a ; the card cannot be used to board a domestic flight or enter a secure federal facility under current federal enforcement.

Use only an I-797 plus an expired visa for REAL IDnot enough alone

Do not rely on these two documents alone. California’s published REAL ID list requires a valid visa in the passport-and-I-94 combination and lists I-797/I-797C only with a Permanent Resident Card; it does not list a generic nonimmigrant I-797 plus an expired visa as a REAL ID identity combination.

For temporary status, DMV generally makes the card expire with your lawful-presence document and allows a new card after a documented status extension.

The I-797 wording mattersFor a regular , DMV lists an only when it shows an approved extension of stay or change of status granting temporary or permanent residency, or says a Resident Alien card is forthcoming. A receipt notice by itself is not that listed route; for REAL ID, DMV separately lists an I-797/I-797C only together with a valid or expired Permanent Resident Card.

It doesn’t matter, I got a real id when I did COS and went without a visa stamp in my passport. It was in NYC. Your i797 should be good enough, take your I-94 too.
