You should have DPS scan your I-797C with your I-94 as pending-extension evidence and act on the returned SAVE response, but the receipt alone cannot compel license issuance or expedited verification.

“I am on a TD visa and filed an I-539 extension. I have a valid I-797C receipt notice, but my Texas driver's license expires in a week. The local DPS supervisor told me the system doesn't accept an I-797C as a valid document for lawful presence, and the SAVE check said 'Returned to Agency'. How do I get Texas DPS to accept my I-797C receipt and push the verification through?”

Resumen

The supervisor is right that the receipt is not proof of granted status, but a categorical refusal to submit it is inconsistent with DPS’s posted pending-extension guidance. Your application may simply be on hold, and the response is now with DPS—not stuck inside SAVE.

Your I-797C belongs in the evidence packet, but the next route depends on the response that SAVE already returned to DPS.

SAVE says verifiedfinish renewal

Ask DPS to continue the held renewal application. The current DPS guide says that, once verifies lawful presence and you satisfy the other licensing requirements and fees, the application continues and DPS issues the card. (Texas DPS DL-62, Rev. 3-2026.)

SAVE says IAV or Resubmit Docsagency action

DPS—not you—must initiate the requested . USCIS says the agency must institute the additional step to obtain a final response and may not rely on a response when prompted verification was left incomplete; DPS says it may resubmit up to twice. (USCIS SAVE Response Guide, Apr. 2022, pp. 1–2; Texas DPS DL-62, Rev. 3-2026.)

The response looks incompleteescalate case

Ask DPS to escalate the case for additional verification and submit every available identifier exactly as shown on your documents. USCIS allows an agency to escalate when it believes the initial response is incorrect or incomplete. (USCIS SAVE Response Guide, Apr. 2022, p. 1.)

DHS records do not verify youfix records

If the final response shows a DHS-record discrepancy, pursue a records correction through the USCIS Contact Center at 1-800-375-5283. DPS cannot issue the card until DHS verifies a period of lawful presence, so if the records are accurate but provide no verifiable period, you may have to wait for a DHS-verifiable result on the I-539. (USCIS SAVE Response Guide, Apr. 2022, p. 11; Texas DPS lawful-presence page.)

Receipt-only issuance or a rushnot available

An does not itself grant immigration status or a benefit, and DPS cannot issue the card before DHS verification. DPS also says SAVE cannot be expedited. (USCIS Form I-797C page; Texas DPS lawful-presence page; Texas DPS DL-62, Rev. 3-2026.)

“Returned to Agency” means SAVE sent a response back to DPS; it does not disclose that response to you.

Watch out for

The receipt is support, not statusUSCIS says an may be accepted as collateral evidence, but it is “only a receipt” and does not show that USCIS granted a benefit. Use it with your and identifying immigration documents; do not demand receipt-only issuance. (USCIS Form I-797C page, updated Jan. 25, 2021.)
The specific DPS document list is oldThe DPS table that expressly allows “a form I-797 indicating a pending application for an extension of status” is marked Rev. 7-13. The current DPS page still links to the guide but warns that it is informational and does not ensure issuance; the March 2026 DL-62 adds that the acceptable-document list is not complete. Use the I-797 language to challenge a categorical refusal to scan the receipt, not as a guarantee of a license. (Texas DPS Verifying Lawful Presence, p. 3; Texas DPS DL-62, Rev. 3-2026.)
There is no SAVE rushTexas DPS expressly says does not allow expedited verification. Its published Texas timeline is 10–13 business days after a second-stage request and up to 25 additional business days after a third-stage request, although USCIS’s general September 2026 estimate for additional verification is approximately five federal workdays. (Texas DPS DL-62, Rev. 3-2026; USCIS SAVE Verification Response Time, updated Sept. 9, 2026.)
Your DPS application has a 90-day clockYou have 90 days from submission of the driver-license application to finish requirements including SAVE; after that, DPS may require a new application and another fee. Track this separately from your I-539 receipt date. (Texas DPS DL-62, Rev. 3-2026.)
Check whether the I-539 was timelyCompare the USCIS received date on the receipt with the expiration of your authorized stay. USCIS’s I-539 instructions say an extension application generally must be submitted before the current authorized stay expires; having a receipt does not by itself answer whether filing was timely. (Form I-539 Instructions, Aug. 28, 2024, p. 1.)

Before the printed license expiration

Bring the pending-extension packet back to DPS

A limited-term renewal is handled in person. Ask the License Permit Specialist to scan the I-94 and I-797C into your existing SAVE case as a pending-extension packet. Show the specialist page 3 of DPS’s posted Verifying Lawful Presence guide: for a pending extension, it calls for immigration documentation with an alien or I-94 number and says an expired document or I-94 may be accompanied by Form I-797 showing the pending extension. The March 2026 DL-62 also says the acceptable-document list is not complete. This requests acceptance for verification; it does not demand immediate issuance.

Requisitos

Form I-797C receipt notice for the pending Form I-539
Current or expired Form I-94 showing the I-94 number
Documents showing the same first and last name and date of birth
SAVE case number from the driver-license transaction
Any DPS instruction letter already received

Today

Obtain the exact SAVE response from DPS

Submit the central Driver License Customer Service form at https://www.dps.texas.gov/section/driver-license/contact-us and call 512-424-2600, Monday–Friday, 7:00 a.m.–5:30 p.m., excluding holidays. State: “CaseCheck says Returned to Agency. Please tell me the exact SAVE response and stage. If it says Institute Additional Verification, please initiate it; if it says Resubmit Docs, please identify and submit the required documents; if verified, please continue my held renewal.” DPS says online responses usually take four to five working days.

Requisitos

SAVE case number
Driver-license application date
I-539 receipt number
Your Texas driver-license number

If the response says IAV or Resubmit Docs

Require the prompted verification stage

Ask the specialist or supervisor to keep the application on hold and institute the next SAVE stage. USCIS says the agency must initiate Additional Verification after an IAV response and may not rely on a response when prompted verification was not completed. DPS says it may resubmit up to twice. If the initial response appears incorrect or incomplete, ask DPS to escalate it; the USCIS SAVE guide expressly permits that.

Requisitos

The response type DPS received
The same immigration-document packet
Any additional document named by DPS

After the returned response is identified

Follow the instruction letter or correct the record

For a second- or third-stage response, DPS’s March 2026 guide says it issues an instruction letter within 48 hours after receiving the SAVE response. If that time has passed, cite DL-62 in the central contact request. If the final response identifies incorrect DHS information, request records correction through the USCIS Contact Center at 1-800-375-5283; DPS cannot correct DHS records or issue the card before DHS verification.

Requisitos

DPS instruction letter or exact final response
Copies of the immigration records that contain the correct information

Until the card is issued

Protect the 90-day application window

Count 90 days from the driver-license application date. DPS may require a new application and an additional fee after that deadline, so follow every document request promptly and contact the central office before the deadline if the case remains held. SAVE cannot be rushed; DPS publishes 10–13 business days after a second-stage submission and up to 25 additional business days after a third-stage submission. Because no official automatic license extension was established, do not assume the pending verification makes the expired card valid.

Requisitos

Original DPS application date
Copies of every DPS message and document submission
