Answered August 2026

No—the office’s AOS-approval rule is not SSA’s rule: your current approved Form I-766 EAD makes you eligible to apply for a work-authorized SSN now.

I entered the US on a K-1 visa, got married, filed my AOS, and received my EAD card. When I went to the SSA office to apply for an SSN, they told me they couldn't issue it until my AOS is approved by DHS. Is this normal, and shouldn't I be eligible for an SSN based on my approved EAD?

Summary

You do not need to wait for your green card just to apply for the SSN. The likely issue is that the office used the wrong rule or stopped at a SAVE-verification problem, both of which have a clear next step.

You have one direct EAD-based route now, with a SAVE-verification branch if SSA cannot confirm the card immediately.

Apply now using the EADuse EAD now

A current Form I-766 is evidence of identity and work-authorized immigration status, and SSA specifically lists C9/C09/C-9 for an applicant. Your green-card application does not have to be approved first.

Complete SAVE verificationif delayed

If the first electronic check does not verify you, SSA’s procedure calls for additional verification when indicated. USCIS reported an approximately seven-federal-workday response time in August 2026; this is an estimate, not a decision deadline.

Wait for AOS approvalnot required

Waiting for the green card is not required when your current approved I-766 already establishes DHS work authorization. Permanent residence would instead let you later receive a card without the DHS-work-authorization legend.

These routes assume your Form I-766 is currently valid; if its category is C9, C09, or C-9, SSA’s own table identifies you as an adjustment applicant.

Watch out for

The dates on the EAD controlYour must show a current validity period. SSA says that period defines when you may work and that a future-dated document is not evidence of current work authorization; an AOS receipt by itself does not replace current work-authorization evidence.
Bring at least two original documentsThe EAD may prove both identity and work-authorized immigration status, but SSA still requires at least two separate documents. Bring originals or issuer-certified copies—not photocopies or notarized copies—including your current Form I-766 and unexpired foreign passport; also bring your foreign birth certificate if you have it or can obtain it within 10 business days.
A SAVE delay is not an AOS requirementIf does not confirm you immediately, SSA should follow the additional-verification process rather than turn the initial mismatch into a rule that your green card must be approved. USCIS expressly says an agency may not deny based on the initial SAVE response when additional verification is required or requested.
The restricted card is normalYour first card should say “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.” That restriction is expected for an EAD applicant: the SSN remains yours, while your valid EAD—not the SSN card—provides the temporary work authorization.

Next steps

These steps turn the verbal refusal into a properly documented EAD-based SSN application and, if necessary, a SAVE review.

Now

Start or restart the first-time SSN request

Start at https://www.ssa.gov/number-card/request-number-first-time. The application is free. Complete the document visit at a Social Security office or Card Center within 45 days after starting online.

Requirements

Current mailing address
Basic biographical information

At the SSA appointment

Bring the required original evidence

Bring originals or copies certified by the issuing agency; SSA does not accept ordinary photocopies or notarized copies. The EAD can cover identity and work-authorized status, but SSA requires at least two separate documents. If the birth certificate is unavailable, SSA may consider your unexpired passport or a DHS document as age evidence.

Requirements

Current original Form I-766 EAD
Unexpired foreign passport
Foreign birth certificate, if available or obtainable within 10 business days

At the counter

Ask SSA to process the current EAD

Say: “I am applying for an original work-authorized SSN using my current Form I-766.” If the card shows C9, C09, or C-9, point to SSA POMS RM 10211.420’s adjustment-applicant row. Ask SSA to enter the application in and run the initial verification; AOS approval is not the required evidence for this route.

Requirements

Check the category and validity dates printed on the EAD

If the initial check does not verify

Use the additional SAVE route if needed

Ask SSA to submit Additional Verification rather than close the application. USCIS’s August 2026 estimate is approximately seven federal workdays. Track the verification at https://www.uscis.gov/save/save-casecheck using your date of birth and one accepted identifier; a pending SAVE check is not an AOS denial or an SSN ineligibility finding.

Requirements

Date of birth
A-Number, EAD card number, I-94 number, or other identifier SSA used

If the office still refuses

Request a written notice if SSA still will not process it

Ask for the written notice required by SSA POMS RM 10210.120 instead of accepting only the verbal statement that you must wait for AOS approval. Keep that notice with your application records and present the cited SSA C09 and SAVE rules when asking the office to reconsider the application.
