Answered September 2026

Yes—go back to DPS with your I-797A and attached I-94, but ask DPS to address the pending verification before assuming a new application will be faster.

“I am on an H1B and recently received my I-797A extension. I also got a new passport that USCIS doesn't have on record. When I went to the Texas DPS to renew my driver's license, they ran my new passport through SAVE instead of my I-797A or I-94. It failed and went to stage 3 verification, which takes weeks. My license is now expired. Is it worth going back to DPS to start a new application and asking them to use my I-797A or I-94 for the SAVE verification instead?”

Summary

Your pending application is on hold while DPS waits for SAVE; the failed first response does not by itself mean your renewal was denied. The hard part is that neither an expired license nor the pending check lets you drive.

The practical fork is whether your existing verification is still pending or has closed—not whether you can present a better document.

Existing case still pendingask first

Return to DPS with your and its attached . Ask which immigration identifiers were submitted and whether DPS can provide the I-94 number, receipt number, and document copies through the existing verification or a permitted resubmission. USCIS tells agencies to enter all available identifiers accurately and permits additional information or documents when requesting further verification; DPS says it may resubmit verification. These rules do **not** promise that an already-submitted stage-three request can be edited. [USCIS SAVE process](https://www.uscis.gov/save/about-save/save-verification-process); [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf).

SAVE case closed or application needs resubmissionif closed

If the case has closed, USCIS says an agency needs a new SAVE case to seek more information; that does **not** necessarily mean you need a new Texas license application. Separately, DPS may require you to resubmit its application and pay an additional fee after its 90-day completion window. Bring the current I-94-based documents for whichever new submission DPS requires. [USCIS SAVE User Reference Guide](https://www.uscis.gov/book/export/html/99415); [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf).

Second application as a guaranteed shortcutnot guaranteed

Do not count on starting a duplicate renewal to erase a pending stage-three check or restore driving privileges. DPS says the application is held until SAVE verifies lawful presence, and its published instructions do not promise that a second application jumps the queue. Ask DPS to address the existing case before paying for another application. [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf).

Neither route permits driving until you have a valid license; DPS says it cannot issue a temporary driving permit while awaiting SAVE.

Watch out for

An expired license is not a driving permitDo not drive on the expired license while SAVE is pending. Texas DPS says it cannot give you a temporary driving permit while it waits for SAVE verification, and Texas law requires a license to drive on a public highway. [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf); [Texas Transportation Code §521.021](https://tcss.legis.texas.gov/docs/TN/htm/TN.521.htm).
Stage three does not prove DPS used only your passportSAVE cannot verify status from a foreign passport number without another immigration identifier, and additional verification requires an immigration identifier. Ask DPS which identifiers it actually submitted; do not assume the new passport caused the delay. [USCIS SAVE verification process](https://www.uscis.gov/save/about-save/save-verification-process).
The pending application has a 90-day windowDPS says an application awaiting SAVE verification is on hold. You have 90 days from submitting the license application to complete its requirements; after that, DPS may require a new application and an additional fee. Going back does not itself reset or bypass the pending verification. [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf).
Do not rely on an older proposed passport ruleTexas’s final rule, effective September 20, 2026, retained a passport-and-I-94 identification category that permits a valid or expired U.S. visa when SAVE verifies the record. The Texas Register explains that DHS clarified this approach despite the federal REAL ID regulation’s facially unexpired-visa wording. It does not make a passport alone sufficient for SAVE or remove the need for verification. [Texas’s adopted rule](https://www.sos.state.tx.us/texreg/archive/September112026/Adopted%20Rules/37.PUBLIC%20SAFETY%20AND%20CORRECTIONS.html); [6 CFR 37.11(c)(1)(vi)](https://www.ecfr.gov/current/title-6/chapter-I/part-37/subpart-B/section-37.11).

Next steps

These steps put your current H-1B extension evidence before DPS without assuming you must start over.

Before visiting DPS

Gather your current immigration and identity documents

Bring originals or issuing-agency-certified copies, not ordinary photocopies. If you entered the United States after the I-797A was issued, print your latest admission record at https://i94.cbp.dhs.gov/I94/recent.html and bring it alongside the approval; do not assume the attached record is your most recent admission. [Texas DPS DL-32](https://www.dps.texas.gov/internetforms/Forms/DL-32.pdf); [CBP I-94](https://i94.cbp.dhs.gov/I94/recent.html).

Requirements

Original I-797A extension notice with its attached I-94
Your current passport and expired Texas license
If you reentered after the extension, a printout of your most recent CBP I-94

While the application may still be pending

Return to a Texas DPS driver license office

Make an in-person appointment at https://www.txdpsscheduler.com. Ask which immigration identifiers DPS entered, whether the SAVE case remains open, and whether staff can supply the current I-94 number, I-797A receipt number, and document copies through the existing case or a permitted resubmission. A limited-term renewal must be in person; USCIS recommends accurate available identifiers, but its guidance does not guarantee an already-submitted stage-three request can be changed. [Texas DPS Temporary Visitors](https://www.dps.texas.gov/section/driver-license/driver-licenses-and-id-cards-temporary-visitors); [USCIS SAVE process](https://www.uscis.gov/save/about-save/save-verification-process).

Requirements

Documents from step one
Your existing renewal receipt or SAVE case number, if DPS gave you one

While DPS waits for a response

Track verification without driving on the expired license

Use USCIS CaseCheck at https://save.uscis.gov/casecheck/ and the Texas DPS License Eligibility page at https://txapps.texas.gov/txapp/txdps/dleligibility/login.do. DPS lists up to 25 additional business days **after it submits** a third-stage request; that is not a promise of a quicker result after a second visit. DPS says no temporary driving permit is available while it awaits SAVE. [USCIS CaseCheck](https://www.uscis.gov/save/benefit-and-license-applicants/save-casecheck); [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf).

Requirements

SAVE case number or the identifier used for the case

If the case closes or the 90-day window expires

Restart only if the case or DPS application requires it

If SAVE closed its case, DPS must create a new SAVE case to request more information. That is different from automatically filing a new license application. DPS says it **may** require a new application and additional fee after 90 days from your original application; its published limited-term driver-license fee is $33. [USCIS SAVE User Reference Guide](https://www.uscis.gov/book/export/html/99415); [Texas DPS DL-62](https://www.dps.texas.gov/internetforms/Forms/DL-62.pdf); [DPS fees](https://www.dps.texas.gov/section/driver-license/driver-license-fees).
