I am about to be hired for a W2 job in NYC on a TN visa, but I plan to work mostly remotely from Toronto and only travel to the US a couple of days a month. How will my taxes work given I have a primary residence and rental properties in Canada, and will there be any complications re-entering the US back and forth on my TN visa?
You will likely remain Canada‑tax resident and U.S. tax nonresident, with Canada taxing all wages and rents and U.S. federal tax reaching U.S. workdays—but New York may tax the full salary unless Toronto is a real employer office, and every TN reentry is inspected.
This arrangement is workable, and frequent Toronto–New York travel is not itself barred by the TN rules. The manageable part is keeping the employer, payroll, work-location records and TN story consistent before the first paycheck and first trip.
