Yes—you can get coverage through NY State of Health as a green-card holder, and enrolling now does not create a separate public-charge test for your citizenship application.

“I recently moved to New York and will be without employer health insurance for about six months. As a Green Card holder, am I allowed to get health insurance through the NY marketplace without violating the public charge rule, keeping in mind I plan to naturalize in three years?”

摘要

You do not have to stay uninsured simply because you plan to become a citizen. The important distinction is between your citizenship application and a possible future admission review after certain foreign travel—not a prohibition on buying insurance now.

Your coverage options depend on your income and other eligibility details—not on your intention to become a citizen.

Private plan at full priceNo subsidy

If you qualify for a private , you can buy it through NY State of Health without financial assistance. New York requires state residence, lawful presence and no eligibility for Medicaid, the Essential Plan or Child Health Plus. DHS expressly excludes healthcare you pay for without government subsidization from public-charge consideration. Private plan with financial helpIncome-based help

If you meet the financial eligibility rules, a can lower your monthly premium; New York calculates assistance using income, household size and where you live. Receiving that help now does not create a separate public-charge test for your citizenship application, but subsidies are no longer categorically excluded if a future admission review applies. Essential Plan if eligibleYear-round enrollment

If you are 19–64, lawfully present, meet the income requirements and are not eligible for Medicaid, Child Health Plus, employer or other coverage, New York's Essential Plan offers $0 monthly premiums and year-round enrollment. It is a different coverage program from a private Marketplace plan; the same existing-green-card and admission-review distinction applies to the immigration question. These are the rules as of October 12, 2026; they do not guarantee what the law will be when you apply for citizenship in three years.

Watch out for

The public-charge rule changed in September 2026Do not rely on older advice saying Marketplace subsidies and Medicaid are always excluded. DHS rescinded the 2022 rule effective September 18, 2026; subsidized healthcare, including premium tax credits, can now be considered when someone is subject to a public-charge admission review. That is not a ban on your enrolling as an existing green-card holder. A relevant exception is returning from a foreign trip lasting more than 180 days, when another admission review can apply. [DHS, 2026 Final Rule](https://www.federalregister.gov/documents/2026/07/20/2026-14539/public-charge-ground-of-inadmissibility); [USCIS Policy Manual, Vol. 8, Part G, Ch. 3](https://www.uscis.gov/policy-manual/volume-8-part-g-chapter-3).
Citizenship still requires a lawful original admissionThere is no separate public-charge test based on insurance you obtain now when you apply for citizenship. However, USCIS can review whether you were lawfully admitted when your green card was originally approved. This answer does not establish your citizenship filing date or guarantee what the law will be in three years. [DHS, 2026 Final Rule](https://www.federalregister.gov/documents/2026/07/20/2026-14539/public-charge-ground-of-inadmissibility); [USCIS Policy Manual, Vol. 12, Part D, Ch. 2](https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-2).
Do not miss the enrollment windowNew York generally requires you to report a qualifying coverage loss or permanent move within 60 days. Losing insurance because you did not pay premiums does not qualify. If you rely on a domestic move rather than coverage loss, New York's enrollment fact sheet also specifies previous coverage within the past 60 days. The Essential Plan, unlike a private Marketplace plan, accepts enrollment throughout the year. Financial help comes with tax paperworkIf you receive advance premium tax credits, report income and household changes to the Marketplace as they happen. You must file a federal income tax return with Form 8962 to reconcile those payments; changes can affect your refund or cause you to owe tax. This is a tax obligation, separate from public charge. Public charge isn’t part of the N-400 at all. It mostly hits green card applications, plus LPRs who spend 180+ days abroad. You already have your card, so naturalization is a seperate process

Discussion of LPR status and naturalization

DHS notes that in general, once it makes an inadmissibility determination and grants admission as an LPR at a POE or approves an alien's application to adjust status to that of an LPR, it does not reevaluate inadmissibility. However, in the context of naturalization, for example, USCIS may, in assessing whether an applicant was lawfully admitted for permanent residence, evaluate whether the alien was admissible at the time of admission or adjustment of status.

Healthcare services aliens pay for without government subsidization would not be considered.
